These Rental Agreement & Terms of Service (“Agreement”) govern the rental of equipment from Hill Country Tote Rental (“Hill Country Tote Rental,” “Company,” “we,” “our,” or “us”).
For purposes of this Agreement, the person or entity who places and pays for a rental reservation is referred to as the "Customer", "Renter", "you", or "your". When a rental is purchased by a third party, including a realtor or brokerage, as a gift for another individual or household, the person or household designated to receive and use the Equipment is referred to as the "Recipient".
By accessing our website, placing a reservation, renting Equipment from us, accepting delivery of our Equipment, or when applicable, accepting a gifted rental as a Recipient, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
Rental Equipment
Hill Country Tote Rental provides reusable moving totes and related moving equipment, including dollies, wardrobe boxes, etc. ("Equipment") for temporary rental. The Equipment remains the sole property of the Company at all times.
Rental Period
Commencement & Termination: The rental period begins on the scheduled delivery date and ends on the scheduled pickup date. The Customer is responsible for all Equipment until it has been returned to and inspected by Hill Country Tote Rental.
For a gifted rental, the Recipient assumes responsibility for the Equipment upon acceptance of delivery and remains responsible for the Equipment until it has been returned to and inspected by Hill Country Tote Rental.
Realtor & Third-Party Gift Rentals
When a rental is purchased by a realtor, brokerage, or other third party as a gift for a Recipient, the Customer is responsible for payment of the rental package purchased at time of booking. The Recipient is responsible for the Equipment once it is accepted and delivered to the Recipient and agrees to comply with all applicable provisions of this Agreement.
The gifted rental includes only the Equipment quantity and rental period purchased by the Customer. Any additional Equipment, rental extensions, delivery services, pickup services, or other charges requested or incurred by the Recipient are not included in the gifted rental and are the responsibility of the Recipient.
The realtor, brokerage, or other third-party Customer who purchases the gifted rental is not responsible for charges incurred by the Recipient after the original gifted rental has been purchased, unless otherwise agreed to in writing.
The Recipient must review and accept this Agreement before accepting or using the gifted Equipment. By accepting delivery, taking possession of, or using the Equipment, the Recipient acknowledges that they have read, understood, and agree to be bound by this Agreement.
Rental Extensions
- Responsibility for Timely Return: The Customer must have Equipment ready for pickup by the agreed-upon date. For a gifted rental, this responsibility applies to the Recipient.
- Additional Rental Time: Standard rentals include up to fourteen (14) days. Subject to availability, the Customer may request up to two (2) additional weeks. Each additional week is charged at 35% of the original package price per week.
- Late Returns: Equipment not returned by the scheduled pickup date without an approved extension may be subject to the applicable additional weekly rental charge described above for each week the Equipment remains in the Customer’s possession.
- Extension Requests: Requests for extensions must be made at least 48 hours prior to the scheduled pickup date and time. Approval is subject to availability. For gifted rentals, any approved extension charges are the responsibility of the Recipient unless otherwise agreed to in writing.
- Assumed Purchase: If Equipment is not returned within 30 days and no communication has been made, the Company will assume the Customer intends to purchase the Equipment and may charge the applicable replacement cost in accordance with the Damage & Replacement Fee Schedule.
Payment
Full payment is due at the time of booking. For standard rentals, the Customer authorizes Hill Country Tote Rental to retain a valid payment method on file until all Equipment has been returned, inspected, and all obligations under this Agreement have been satisfied. The Customer further authorizes Hill Country Tote Rental to charge that payment method for rental fees, taxes, approved extensions, late fees, applicable delivery or pickup fees, cleaning charges, damage, missing or unreturned equipment, and any other charges authorized under this Agreement.
For Realtor or third-party gifted rentals, the Customer's payment obligation is limited to the gifted rental purchased at the time of booking, unless otherwise agreed to in writing. The Recipient is responsible for any additional charges incurred after the gifted rental is purchased, including approved extensions, additional Equipment, applicable delivery or pickup fees, cleaning charges, damage, missing or unreturned Equipment, and other charges authorized under this Agreement. Any additional charges owed by the Recipient must be paid by the Recipient using a valid payment method provided to Hill Country Tote Rental.
Cancellation
- Cancellations made 48 hours or more before the scheduled delivery date will receive a full refund.
- Cancellations made less than 48 hours before the scheduled delivery may be charged a cancellation fee.
- Same-day cancellations may not be eligible for a refund.
For gifted rentals, any refund will be issued to the original Customer who made the payment unless otherwise agreed to in writing.
Delivery & Pick Up
To ensure the accuracy of inventory and the condition of rental equipment, an adult (18 years or older) must be present at both the scheduled delivery and scheduled pickup.
Hill Country Tote Rental will document the Equipment quantity and condition at delivery and pickup. Documentation may include inventory records, photographs, delivery and pickup records, and other reasonable documentation maintained by the Company.
If the Customer or Recipient authorizes Hill Country Tote Rental in writing to deliver or retrieve equipment without the Customer or Recipient present, you agree that Hill Country Tote Rental’s documented inventory count and condition report (including photographs, if taken) shall be considered accurate and accepted.
Access to Equipment at Pickup
Equipment must be accessible at the scheduled pickup time. If Equipment is inaccessible, unavailable, or pickup cannot be completed due to Customer or Recipient circumstances, additional pickup or redelivery fees may apply.
Authorized Representative
The Customer or Recipient may designate another adult (18 years or older) to be present on their behalf for delivery and/or pickup. The Customer or Recipient remains responsible for the Equipment and for ensuring that the authorized representative has access to the designated delivery or pickup location.
The presence of an authorized representative does not transfer responsibility for the Equipment from the Customer or Recipient.
Customer Responsibilities
The Customer and, where applicable, the Recipient agree to:
- Use the equipment only for its intended moving and storage purposes.
- Do not exceed the manufacturer’s maximum load capacity of 65 lbs. per tote.
- Do not stack loaded totes more than five (5) high. Stacks must be stable and located on a level surface.
- Keep all equipment secure and protected from theft, loss, misuse, and damage.
- Return all equipment in substantially the same condition as received, excluding normal wear and tear.
- Notify Hill Country Tote Rental immediately if equipment is lost, stolen, or damaged.
For gifted rentals, the Recipient is responsible for these obligations once the Recipient accepts possession of the Equipment.
Customer and Recipient may not:
- Paint, drill, alter, or modify any rental equipment.
- Use equipment for hazardous materials.
- Use equipment for commercial hauling without prior approval.
Cleaning
Equipment must be emptied before pickup and returned free of excessive dirt, debris, liquids, paint, chemicals, or other contaminants. Equipment requiring excessive cleaning may incur a cleaning fee.
Damage
Normal wear is expected. Examples of normal wear include minor scratches and light scuffs. The Customer is responsible for returning all Equipment in substantially the same condition in which it was provided. The Customer may be responsible for damage, loss, or excessive cleaning, including cracked totes, broken or missing lids, melted plastic, permanent stains, smoke or chemical odors, missing items, or other damage that prevents the Equipment from being reasonably reused.
For gifted rentals, the Recipient becomes responsible for the Equipment once they accept possession. The Recipient is responsible for any damage beyond normal wear and tear, excessive cleaning, missing or unreturned Equipment, or other applicable charges incurred during their possession of the Equipment.
Any applicable cleaning, repair, damage, loss, or replacement charges will be assessed in accordance with Hill Country Tote Rental’s Damage & Replacement Fee Schedule, which is incorporated into and made a part of this Agreement. Charges will not exceed the reasonable repair or replacement cost of the affected Equipment.
Hill Country Tote Rental will inspect all returned Equipment after the rental period. Applicable charges will be charged to the payment method on file or, for gifted rentals where no payment method is on file for the Recipient, invoiced to the Recipient.
Limitation of Liability
Hill Country Tote Rental shall not be liable for:
- Injury resulting from improper use, overloading, or misuse of rented Equipment.
- Damage to personal property.
- Loss of contents stored within rented equipment
- Delays caused by weather, traffic, accidents, equipment shortages, or events beyond our reasonable control.
- Any indirect, incidental, or consequential damages arising from the use of rented Equipment.
Assumption of Risk
Customer and Recipient acknowledge that moving and lifting involve inherent risks and assume responsibility for the safe use of all rented Equipment. Customer and Recipient agree to exercise reasonable care when lifting, stacking, transporting, and handling Equipment.
Indemnification
Customer and Recipient agree to indemnify, defend, and hold harmless Hill Country Tote Rental, its owners, employees, contractors, and representatives from any claims, damages, injuries, liabilities, costs, or expenses arising from the respective use of rented Equipment or violation of this Agreement.
Refusal of Service
Hill Country Tote Rental reserves the right to refuse service, delivery, or rental requests for any lawful reason.
Governing Law
This Agreement shall be governed by the laws of the State of Texas.
Acceptance
By placing a reservation, completing payment, checking the box indicating acceptance of these Terms of Service during checkout, or, in the case of a gifted rental, completing the required recipient confirmation and acceptance process, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
For gifted rentals, the Recipient must complete the required recipient confirmation and acceptance process before accepting or using the Equipment. The Recipient acknowledges responsibility for the Equipment from the time the Recipient accepts delivery or otherwise takes possession of the Equipment until the Equipment has been returned to and inspected by Hill Country Tote Rental.
